The following information on data privacy applies to visits to our webpages as well as to the software offered by OrchPlayMusic. Information on the type, purpose, and scope of data processing is provided hereunder.

We are aware that the careful handling of personal data is of utmost importance. When collecting, processing, and using data we strictly comply with the provisions of the law.

To ensure the privacy of personal data, we implement technical and organizational measures to protect such data. These measures entail procedural and electronic security features in the processing of data, as well as the training of our teams and their obligation to ensure data privacy.

PERSONAL DATA

The following information applies to the processing of personal data. Personal data are defined as any information related to an identified or identifiable natural person. Such data may be any information provided, such as name, address, email address, including payment information or online identifiers, as well as browsing behavior.

1. ADVERTISING

The OrchPlayMusic websites and the OrchPlay software are free of advertisements of any kind. OrchPlayMusic does not collect advertising revenues.

2. COLLECTING DATA FROM WEBPAGE VISITORS

2.1 USAGE DATA

We do not collect the data which is transmitted by your browser when you visit to our webpages.

2.2 COOKIES

OrchPlayMusic does not use first-party or third-party cookies.

Cookies are small text files (alphanumeric identifiers) that are stored on your terminal when you visit a webpage. The information stored is sent back to the respective servers during a repeat visit.

When you visit our webpages, cookies can be stored on the device you use to access our website. Such cookies are generated by your browser and enable the automatic login into your OrchPlay user account.

Please note that you may also configure your browser in the browser settings in such a way to object to the use of specific types of cookies or to block them from the outset. You may still visit our webpages if you have blocked the setting of cookies.

2.3 THIRD-PARTY WEB ANALYTICS

OrchPlayMusic does not use any third-party web analytics services. GoogleAnalytics, for general anonymous statistical information on the number of daily and monthly visitors, may be implemented in the future.

2.4 MARKETING
2.4.1 GENERAL

OrchPlayMusic does not conduct advertising campaigns targeted to current or previous OrchPlay users specifically.

We communicate by email to academic institutions representatives that may, at their discretion, communicate information to their students and teachers about OrchPlay features and updates through their library resources pages.

2.4.2 FACEBOOK

Facebook advertising conducted in 2016 was targeting a randomly selected group of musicians interested in classical music and music pedagogy. Since 2017 no additional marketing has been conducted on that platform.

2.5 YOUTUBE

We embed YouTube videos on our webpages and within our OrchPlay application. When you watch a YouTube video embedded on our webpages, a connection to youtube.com is established. This connection is required to display the respective video on our webpages in your browser. Google is responsible for the processing of data and the setting of cookies by YouTube. Such processing is beyond our control.

It should be noted that YouTube records and processes at least the IP address of your terminal, the date and time at which you watched the video, and the webpage you visited. Furthermore, a connection to Google's DoubleClick advertising network is established. Google provides further information on Google Ads as well as on opt-out options here as well as here.

If you are logged into YouTube when accessing our website, YouTube assigns the connection information to your YouTube account. If you wish to prevent this, you have to either log out of YouTube before visiting our webpages or make the relevant settings in your YouTube account.

2.6 SOUNDCLOUD

We use the SoundCloud platform to share stereo previews of our multichannel recordings in our News page. SoundCloud is responsible for the processing of data and the setting of cookies on their platform. Such processing is beyond our control.

2.7 APP-SPECIFIC PROCESSING

The OrchPlay application does not run first-party or third-party processes which collect personal data from users.

2.8 LINKS TO THIRD-PARTY PROVIDERS

We also provide links to third-party providers and to our website on Facebook, SoundCloud and YouTube. When clicking on the relevant icon (such as the Facebook button) at the bottom of our website you will be redirected accordingly. OrchPlayMusic is not responsible for the ensuing processing of data by third-party providers. The companies responsible provide information on data processing in their respective privacy policies.

3. ADDITIONAL DATA PROCESSING REGARDING NEWSLETTERS

OrchPlay no longer offers a Newsletter. If this feature was to be implemented once more details would be specified in this section.

4. CONTACT AND CUSTOMER SUPPORT

4.1 EMAIL

If you contact us by email, we will use your email address and your name so we may attend to /respond to your request.

4.2 CUSTOMER SUPPORT

Users may also contact our customer support. We use the email address and name of the person contacting us to attend to the respective request.

5. ADDITIONAL DATA PROCESSING REGARDING USER ACCOUNTS

A user account is needed to view the data of current and past licences.

The mandatory information to be provided includes your name, email address, and a password of your choice. All other information may be given voluntarily and is marked accordingly.

6. ORDERING, ACTIVATING, AND REGISTERING PRODUCTS
6.1 ORDERING PRODUCTS

You may place orders in our website or through the application when logged-in your user account.

6.2 PAYPAL

Transactions are processed by PayPal, which is responsible for the processing of data on their platform. Subscriptions for individual licences(non-institutional) are renewed automatically unless you cancel the recurring subscription using the PayPal interface.

6.3 ACTIVATING SOFTWARE PRODUCTS

Before you can download files from the OrchPlay Music Library, you have to login with a valid Pro or Teacher license.

7. DISCLOSURE OF PERSONAL DATA

We will not disclose your personal data to any third-party.

8. OBLIGATION TO PROVIDE DATA

There are no contractual or legal obligations for you to provide us with your personal data. However, we may not be able to offer our services without a valid name and email address.

9. RIGHTS OF PEOPLE AFFECTED
9.1 RIGHT TO INFORMATION

You have the right to request confirmation as to whether your personal data are processed, and if so, which specific data are processed and for what purpose(s).

9.2 RECTIFICATION

You have the right to demand that inaccurate personal data be rectified without undue delay.

9.3  RIGHT TO ERASURE

Once your user relationship has been terminated and the legal retention periods pursuant to tax and commercial law have expired, you may request for your personal data to be erased. Your customer account will otherwise remain available for a future subscription renewal.

You may demand the erasure of your data at any time if the data are no longer required for performing contracts.
